Children’s Injury Compensation In Queensland
14th November 2025
When a child is hurt, the aftermath can be overwhelming for families. Besides immediate medical concerns, you might wonder what options exist for seeking compensation. AX Compensation Lawyers is here to clarify how children’s injury compensation claims in Queensland work and to guide families through every stage of the process.
How does a Child make decisions for a Compensation Claim?
Children cannot manage legal proceedings themselves. If someone under the age of 18 suffers an injury, their parent or legal guardian steps in as a Litigation Guardian. This person makes all decisions about the claim — from instructing lawyers to signing claim documents and negotiating settlements. The Litigation Guardian must always act in the child’s best interests and explain the process and developments in terms the child can understand.
The Process for Children’s Compensation Claims
Aside from the involvement of a Litigation Guardian, children’s claims generally follow the same process as adult claims. The claim is commenced by sending a claim form to the party at-fault. The child will generally be required to attend a medical examination to confirm the injuries that have been sustained and describe any long-term impacts they may have. The loss and damage that the child might suffer because of their injuries can be difficult to determine – this is where a lawyer’s involvement can really help!
There is one additional step which occurs after the conclusion of a child’s claim which makes it different to an adult claim. Claims involving children are not fully finalised until a judge of the courts has “sanctioned” or approved the amount of compensation. This step is mandatory, regardless of the value of the settlement.
The judge acts as an independent third party to review the evidence and confirm the amount of compensation is fair and reasonable in the circumstances. Once the court has provided this tick of approval, the settlement money is not paid to the Litigation Guardian. Instead, the funds must then be held by The Public Trustee or other suitably qualified entity until the child turns 18. The child’s parent or guardian can apply to The Public Trustee for access to the funds for things like medical treatment. Once the child turns 18, The Public Trustee will release the settlement money to them.
If a child turns 18 before their claim has been finalised, they take over the decision-making from the Litigation Guardian.
Deadlines for Starting a Claim
For most personal injury cases in Queensland, there is a three-year time limit to begin the legal action, starting from the date of the accident. For children, however, the clock does not start until their 18th birthday, meaning they effectively have until age 21 to commence a claim.
However, there are benefits to starting the claim process as early as possible such as securing vital evidence and witness accounts, which can be harder to obtain over time.
Typical Causes of Childhood Injuries Leading to Claims
Children can be hurt in many ways, including:
- Falls and slips: Injuries from unsafe surfaces or poorly maintained environments.
- School-related incidents: Accidents at school, during sport, or on playgrounds.
- Road crashes: Injuries as passengers, pedestrians, or cyclists in traffic accidents.
- Public space accidents: Harm in parks, shopping centres, or community venues.
- Product defects: Injuries from unsafe or malfunctioning toys and equipment.
- Animal bites or attacks: Injuries caused by pets or dangerous animals.
- Bike accidents: Collisions with vehicles or other cyclists.
Evidence Is Key – What Should Families Document?
Because children have a longer window to bring a claim, details can easily fade, and important evidence can be lost over time. Keeping detailed records strengthens the case — even if it is made years later.
Essential documentation includes:
- Medical assessments and treatment records
- Accident or incident reports from schools, clubs, or public venues
- Statements from people who witnessed the event
- Photos or videos showing injuries, accident location, equipment involved, and recovery progress
The more detailed and contemporaneous the records, the stronger the case will be.
Why Are Compensation Claims for Minors Often Complex?
Claims involving young people commonly take longer than those for adults. It is often necessary to wait to have injuries medically assessed to determine how they might affect the child’s growth, long-term health, education, and earning capacity into their adult years.
Calculating future financial loss is complex since children have not yet entered the workforce. These uncertainties require additional expert input and time, which is why seeking experienced legal help is so important.
