Yes, as a passenger in a vehicle, you can make a car accident claim against a CTP (Compulsory Third Party) insurer if you are injured in an accident. It does not matter whether the driver of the vehicle you were in, or another driver was at fault—you are still entitled to claim. CTP insurance covers passengers, as well as drivers, pedestrians, and other road users, provided at least one driver involved was at fault or partially at fault for the accident.

In some cases, the CTP insurer may be responsible for paying a portion of your legal costs associated with bringing a motor vehicle claim against them. For this to occur the amount of compensation paid must exceed certain thresholds. You will never recover 100% of your legal costs.

In the majority of cases, CTP claims in Queensland are resolved through negotiation and settlement without the need to go to court. Most claims are settled through discussions between your legal team and the insurer, which can lead to a fair settlement.
